General Conditions
GENERAL
The general terms and conditions of Tiemex logistic services B.V. apply to all orders carried out by Tiemex logistic services B.V. (Chamber of Commerce registration number 10025040 Tiemex)(09092700 Stefco).
TRANSPORT MEDIATION AND DISTRIBUTION
Tiemex logistic services B.V. and Stefco logistic services act as an intermediary. The Dutch Forwarding Conditions apply to all orders that you place with us (in their latest version) most recently filed at the District Courts of Amsterdam, Arnhem, Breda and Rotterdam on 1 July 2004. Insurance cover must be expressly ordered in writing and the costs of such cover will be borne by the customer.
STORAGE, VALUE ADDED LOGISTICS AND VALUE ADDED SERVICES
The PD (physical distribution) conditions (in their latest version) most recently filed at the District Courts of Amsterdam and Rotterdam on 1 September 2000 apply to all storage activities and the value added logistics and value added services. Insurance cover must be expressly ordered in writing and the costs of such cover will be borne by the customer.
PAYMENT TERMS FOR ALL SERVICES
The T.L.N. (Netherlands Transport and Logistics Network) General Payment Terms (in their latest version) most recently filed at the District Court of The Hague on 1 October 1993 apply.
INTERNATIONAL TRANSPORT
In such cases where goods are transported internationally by road, as described in the convention on the contract for the international carriage of goods by road (CMR), the convention is applicable if the place of receipt of the goods to be transported and the intended place of delivery are located in two different countries, where at least one country is subject to the convention, as published on www.vervoeradres.nl, as well as the General Transport Conditions 2002 (AVC 2002), as filed with the District Courts of Amsterdam and Rotterdam.
APPLICABLE LAW
Dutch law applies to all orders placed by you insofar as this does not contravene any mandatory statutory provision contained in the aforementioned conditions.
